Terms and Conditions for purchasing artwork

The terms and conditions are set out below. We value providing personal service and understand what an important purchase your artwork will be. If you have any queries about purchasing an original or a print or are unsure how the terms and conditions may apply to your order, please don’t hesitate to contact us.

Ordering
Artwork by Wendy Buiter is available to purchase from her atelier, online, or from any of her exhibitions.

Delivery and shipping
Delivery is usually by PostNL within the Netherlands and UPS, TNT, or DHL for international shipping. Your order is usually dispatched within 10 working days. But it may take up to 3 weeks to arrive at your address. Note that international customs charges are the buyers’ responsibility.

If you see any damage when your package is being delivered, you can either refuse the shipment as [damaged – return to sender] or you can have the delivery company mark the tracking as [received damaged, subject to further inspection]. Please file the claim immediately! You also must keep all boxes and packing material. When you call you will need the tracking number of your box, a description of the damage, and its value). Take pictures of the damaged package and send them to us via sales@wendybuiter.com with the info of your actions on it.

Additional Surcharge
If you would like to have the artwork within a specific time please contact us for options. A priority surcharge may be applied.

Downloadable artworks
These downloads are for personal use only. So you can use it as a background for your phone or print them out for yourself in A4 size to frame and decorate your home with. But the designs are not to be resold or used for commercial purposes or advertising.

Commissioning an artwork
On receipt of a commission, you will be provided with a specification, an approximate timescale for delivery, and a price, which will include a price for delivery. Please note that all artworks must be paid for in € (EUR) therefore the price for a commission may change due to fluctuations in exchange rates if you are completing the transaction in another currency. Additional bank costs are for the responsible sender of the payment.

The full payment in advance is required for all commissions which are non-refundable. Work is not started on any artwork before the payment is received. On paying you are entering into a contract with the artist for the provision of artwork, agreeing to the specification provided by Wendy Buiter, and paying the total price quoted at a date to be agreed upon. You are also agreeing to these terms and conditions.

Once the payment is received, a charge may be applicable to change the specification of your artwork. While Wendy Buiter will always try and incorporate the changes required by the customer, they may not always be possible once work on a piece has started.

Returns and cancellations – customized and commissioned items
Under your contract with Wendy Buiter, the supply of goods (your artwork) is made specifically to meet your specifications and therefore your order cannot be canceled after it has been ordered.

In the highly unlikely event, your commission does not match your specification or you believe there may be issues with the quality of the product, we will endeavor to resolve the situation to your satisfaction as quickly as possible. Please contact us to explain your specific queries and agree on a course of action.

Returns and cancellations – non-customized and non-commissioned items
If you wish to return any non-commissioned items purchased from Wendy Buiter they must be returned within 14 days of receipt for a refund. Items must be in their original state. You are responsible for ensuring the item is returned to Wendy Buiter in its original state and without any damage. Delivery charges are not refunded. Wendy Buiter will refund the cost of the item in full, however, please note that if you paid for the item using PayPal, PayPal may charge you for the return of funds, and any charge incurred is not covered by Wendy Buiter.

In the unlikely event, there is an issue with the quality of the product or it is not the product ordered, we will endeavor to resolve the situation to your satisfaction as quickly as possible. Please contact us to explain your specific queries and agree on a course of action.

Privacy Policy
This website does not collect any personal information other than that entered by those purchasing products. Any information provided to purchase a product is solely used for that purpose and is not disclosed to any third party. Credit card details are only retained as required by the processing company to demonstrate approval for the transaction provided by clients. This website uses Google Analytics to record information about site usage. Click here for privacy and cookie information.

Terms and conditions for purchasing online course programs

Please read these terms and conditions carefully before enrolling in an online course program. By enrolling in a course, you agree to be bound by these terms and conditions. If you do not agree to these terms and conditions, do not enroll in the course.

If you are participating in one of Wendy Buiter’s course programs and there is a problem about which you cannot find anything in these terms and conditions, please contact us, so that we can look for a solution together.

General
These general terms and conditions apply to all offers, quotations and agreements, and other legal relationships between you and Wendy Buiter. Wendy may change these terms and conditions. The most recent version is always available on the website www.wendybuiter.com

Offer
Wendy will make a written offer, by email, on the website, and via webinars.

Offers are valid for the time specified in the offer, no more after that.

You agree to the offer in the manner stated in the offer. Your agreement is only final when Wendy has confirmed it.

The offer is only for entrepreneurs/businesses. If you are not an entrepreneur or are not (yet) registered with the Chamber of Commerce, Wendy may refuse your application and choose not to confirm your agreement.

Agreement
The agreement is concluded when you agree to the offer and you have paid the agreed fee.

Wendy assumes her best-efforts obligation for this agreement but does not give any guarantee about the achievement of the intended result.

Wendy may change, renew, replace or modify the content she provides under our agreement.

Are you not satisfied with the online training or membership? Unfortunately, Wendy does not offer a money-back guarantee. You can contact us if there is a breach of contract.

Online training courses
Wendy offers various online training courses. These can be paid in one lump sum or in installments. A membership or subscription is not an online training.

Access to the online training is personal. So you are not allowed to share your login details and the materials from the online training with others. Any live sessions are also only accessible to you. If you do share your login details with someone, We may block access to the online training and all your rights will expire. We will then terminate the agreement between you and Wendy and you are not entitled to a refund.

You can only participate in an online training after payment.

You will have access to the online training as long as the online training exists. Wendy will always ensure that the online training is accessible for at least three months after you have registered for the online training.

Sometimes Wendy also offers access to a Facebook group or other online community with the online training. This is for a maximum of twelve months. This is only different if it was stated that way in the offer.

You must have an internet connection to take an online training. Wendy is not liable for damage or missed training components because you do not have the correct equipment or internet connection.

Unless stated otherwise in the offer, you are not entitled to personal coaching or live (group) sessions.

The online training can be followed at the moment you choose.

If you have agreed on VIP guidance, you and wendy will agree on the dates for the guidance.

General Provisions
This Agreement, including our Privacy and Cookie Policies which are incorporated herein, constitutes the entire agreement between the parties and reflects a complete understanding of the parties with respect to the subject matter.

If any provision of this Agreement is held invalid or unenforceable, the remainder of this Agreement will remain in full force and the invalid or unenforceable provision will be replaced by a valid or enforceable provision.

This agreement supersedes all prior written and oral representations.

If you do not agree with these terms and conditions, do not purchase or use the Program or Content.
