Terms & Conditions
These Terms and Conditions apply to all purchases of artworks and related products created by Wendy Buiter. By placing an order, the buyer confirms having read, understood, and accepted these Terms in full.
1. General
All artworks are created by Wendy Buiter and sold through the studio, online boutique, or official exhibitions and events. All sales are subject to availability. Prices are listed in euros (€) and may be adjusted without prior notice.
Once an order is confirmed, a binding agreement is formed between the buyer and the artist. The artist reserves the right to decline or cancel any order at her discretion.
2. Delivery & Shipping
Orders are shipped from the Netherlands. Domestic shipments are typically handled by PostNL. International shipments may be handled by UPS, DHL, or TNT.
• Standard dispatch time: within 10 working days
• Estimated delivery time: up to 3 weeks, depending on destination and customs procedures
Any customs duties, taxes, or import fees are the sole responsibility of the buyer.
3. Inspection Upon Delivery
Upon receipt, the buyer is responsible for inspecting the shipment.
Visible transport damage must be reported immediately to the courier and documented accordingly. All claims must be submitted with photographic evidence and original packaging within 48 hours of delivery via sales@wendybuiter.com.
Failure to follow this procedure may result in the claim being declined.
4. Framing, Installation & Additional Services
Framing and installation are offered as an additional service and do not include long term guarantees, unless explicitly agreed otherwise in writing.
Any framing or mounting performed by the artist is offered as a courtesy. The artist is not a professional framing service provider and does not provide long term warranties on framing, mounting, or installation methods.
Minor shifts, settling, or adjustments of framed works may occur over time due to gravity, temperature, humidity, or environmental conditions. Such adjustments are considered normal maintenance and fall under the responsibility of the owner.
Requests related to framing, mounting, or installation must be reported within 14 days of delivery. Requests made after this period cannot be accepted.
5. Artwork Care & Stewardship
Artworks are intended to be enjoyed over time and, when properly cared for, may be passed on and appreciated by future generations.
Upon delivery, the buyer assumes full responsibility for the care, preservation, and safeguarding of the artwork. This includes maintaining a suitable environment with stable temperature, humidity, and light conditions.
Normal aging processes, environmental influences, and minor changes over time are inherent to artworks and do not constitute defects.
The artist cannot be held responsible for damage, deterioration, or changes resulting from improper handling, installation, storage, environmental conditions, or lack of appropriate care.
6. Commissioned Artworks
Commissioned works are created specifically for the buyer.
• Full payment is required in advance
• Payments are non refundable
• Production begins only after payment has been received
Once work has commenced, changes may not be possible or may incur additional costs. Artistic discretion remains with the artist to protect the integrity of the work.
7. Returns & Cancellations
7.1 Commissioned & Customized Works
Commissioned or customized artworks cannot be canceled, returned, or refunded once production has started.
In the rare event that the delivered artwork does not correspond with the agreed specification, the buyer must notify the artist within 5 working days of receipt.
7.2 Non Commissioned Works
For non commissioned works, the buyer may request a return within 14 days of delivery.
Returned items must be unused, undamaged, and in original packaging. Return shipping costs are the responsibility of the buyer. Shipping and transaction fees are non refundable.
8. Digital Artworks
Digital files are sold for personal, non commercial use only.
Reproduction, resale, distribution, modification, or commercial use is not permitted without prior written consent. All intellectual property rights remain with the artist.
9. Intellectual Property
All artworks, images, and designs remain the exclusive intellectual property of Wendy Buiter.
The purchase of an artwork does not grant reproduction, licensing, or commercial rights unless explicitly agreed in writing.
10. Liability
Ownership of the artwork transfers upon delivery. From that moment onward, responsibility for care, maintenance, insurance, and safekeeping rests entirely with the buyer.
The artist is not liable for damage caused by improper handling, installation, environmental conditions, normal aging, or lack of appropriate care.
11. Care, Use & Responsibility
Artworks are intended to be handled, displayed, and preserved with care and respect.
The artwork may not be intentionally damaged, altered, dismantled, or subjected to actions that could reasonably result in deterioration or destruction. This includes improper handling, exposure to unsuitable environments, or unauthorized modifications.
Any damage resulting from misuse, negligence, intentional actions, or lack of appropriate care is the responsibility of the owner and does not constitute a defect or liability on the part of the artist.
By acquiring an artwork, the collector accepts a duty of care, ensuring that the work is treated as a valuable cultural object worthy of preservation for future generations.
12. Privacy
Personal data is collected solely for order processing and communication purposes. Data is never sold or shared with third parties. Payment processing is handled securely by third party providers.
13. Governing Law
All agreements are governed by Dutch law. Any disputes shall be submitted exclusively to the competent court in Rotterdam, The Netherlands.
